Terms of Service

These terms are a contract between you and Adam Badar, trading as Axonal Labs, the publisher of Luna ("Luna", "we", "us"). Luna is published by an individual, not a company; Axonal Labs is a trading name and not a separate legal person. By creating an account, tapping "continue" during onboarding, or using the app, you agree to them. If you do not agree, do not use Luna.

Luna is distributed through the Apple App Store. Section 12 contains the terms Apple requires in this agreement, and Apple is a third-party beneficiary of it.

1. What Luna is

Luna turns a description of the life you want into personalised audio affirmations and guided visualisations. You tell us details about your goals; we generate narrated content built from those details and play it back to you.

Stories and affirmations are written by an AI model, and the narration is a synthetic voice, not a human reading. Nothing in Luna is recorded by a person.

Luna is a self-guided wellbeing product. It is not healthcare. It does not diagnose, treat, cure, or prevent any medical or psychological condition, and it is not a substitute for advice from a doctor, therapist, or other qualified professional. If you are in crisis or think you may have a medical emergency, contact your local emergency services.

We make no promise that any goal you describe will come about. Nothing in the app is financial, legal, medical, or professional advice.

2. Who can use it

You must be at least 13 years old. If you are under the age of majority where you live, you may use Luna only with the involvement of a parent or guardian who accepts these terms on your behalf.

3. Your account

Luna opens an anonymous, device-scoped account so you can use the app before signing in. You may later sign in with Apple, which upgrades that account.

You are responsible for what happens under your account. If you sign in with Apple on a device you share, anyone with access to that device may be able to see your content.

If you sign in with an Apple ID that already has a Luna account, you get that existing account. We do not merge it with the anonymous one on your device, because silently combining two sets of content is worse than the honest behaviour. Content that lived only on the anonymous account may become unreachable.

4. What you give us and what you may not send

You keep ownership of everything you write and record ("your content"). You grant us a licence to store, process, and transmit your content, and to send it to the service providers listed in the Privacy Policy, solely to operate Luna for you. This licence ends when you delete the content or your account, except for backups that expire on their normal cycle.

You may not use Luna to create or store content that is illegal, that sexualises minors, that harasses or threatens a real person, that infringes someone else's rights, or that impersonates someone. You may not use another person's name, likeness, or private details in ways they have not agreed to. You may not attempt to break, overload, reverse-engineer, or scrape the service, or use it to build a competing product.

We screen what you send with automated moderation before we generate anything from it, and we may refuse a request that fails those checks. Automated screening is imperfect in both directions: it will sometimes refuse something harmless, and it will not catch everything. We may remove content or suspend an account that breaks these rules.

5. Generated content

Luna's text and audio are produced by automated systems from what you tell it. It may contain mistakes. Do not rely on it as a statement of fact. We do not claim ownership of the output generated for you, and as between you and us, it is yours to use for personal, non-commercial purposes. We cannot guarantee that output generated for you is unique, and similar output may be generated for someone else.

6. Subscriptions and payment

Luna has a free tier with limits and a paid subscription, Luna Premium, that raises them. Subscriptions are sold by Apple through your Apple ID, not by us.

Luna Premium is offered as three plans, and no others:

Prices are shown in your local currency on the subscription screen inside the app before you buy, and that screen is the authority: prices vary by storefront and may change. There is no lifetime or one-time purchase of Luna Premium, and no annual plan. Anything offering one is not us.

What each plan includes is stated on the subscription screen. All three unlock the same features; they differ in how many stories you may create in a period. Affirmations are not capped on any plan. We apply a daily ceiling on story creation on every plan, including paid ones, as an anti-abuse measure.

Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours of the end of the period, at the price for your plan. Manage or cancel a subscription in your Apple ID account settings; you cannot cancel it from inside Luna.

Free trials. A one-week free trial is offered on the Monthly and 6-month plans to Apple IDs that are eligible for it, as determined by Apple. The Weekly plan has no trial. If you do not cancel before the trial ends, it converts to the paid plan and your Apple ID is charged. Any unused portion of a free trial is forfeited when you buy a subscription.

Refunds are handled by Apple under its own policy, not by us. We cannot issue, and do not control, refunds for App Store purchases.

We may change prices. A price change affects you only from the next renewal after we tell you, and you can cancel before it takes effect.

7. Ending it

You may stop using Luna and delete your account at any time from Settings. Deleting your account deletes your content immediately, as described in the Privacy Policy. Deleting a single story hides it but does not erase it; only account deletion does that.

Deleting your account does not cancel your subscription. Cancel it in your Apple ID settings, or Apple will keep charging you for an account that no longer exists.

We may suspend or end your access if you break these terms, or if we stop offering Luna. If we end your access for reasons other than your breach and you have paid for an unused period, contact us and we will help you seek a refund from Apple.

8. Disclaimers and liability

Luna is provided "as is". To the fullest extent the law allows, we disclaim all warranties, including fitness for a particular purpose and any warranty that the service will be uninterrupted or error-free.

To the fullest extent the law allows, our total liability to you for any claim relating to Luna is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 USD. We are not liable for indirect, incidental, or consequential damages, or for lost profits or lost data.

Some jurisdictions do not allow these limits. Where that is the case, they apply to you only as far as the law permits, and nothing here removes rights you have as a consumer that cannot be waived.

9. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-laws rules. The courts of Ontario have exclusive jurisdiction over any dispute arising out of these terms, and you and we each consent to their jurisdiction.

If you live in a country whose law gives you the right to bring proceedings in your own courts or under your own law, nothing here takes that right away.

Before filing anything, contact us at the address in section 13. Most disputes are resolved faster that way, and we will do the same before contacting you.

10. Changes

We may update these terms. If a change is material, we will give notice in the app before it takes effect. Continuing to use Luna after that means you accept the new terms.

11. If part of this fails

If any provision of these terms is held unenforceable, the rest stays in effect and the unenforceable provision is limited to the minimum extent necessary rather than struck out entirely. Our not enforcing a provision on one occasion is not a waiver of it.

These terms, together with the Privacy Policy, are the entire agreement between you and us about Luna. You may not assign them; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.

12. Apple and the App Store

This section contains the terms Apple requires in an end-user licence agreement for an app distributed through the App Store. Where it conflicts with anything else in these terms, this section governs for App Store distribution.

  1. This agreement is with us, not with Apple. These terms are concluded

between you and Adam Badar, trading as Axonal Labs, only, and not with Apple. We, not Apple, are solely responsible for Luna and its content.

  1. Scope of licence. We grant you a limited, non-transferable,

non-exclusive licence to use Luna on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that Luna may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing where we have enabled it. The licence is for personal, non-commercial use.

  1. Maintenance and support. We are solely responsible for providing any

maintenance and support services for Luna, as specified in these terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services for Luna.

  1. Warranty. We are solely responsible for any product warranties, whether

express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Luna to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Luna to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Luna, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

  1. Product claims. We, not Apple, are responsible for addressing any claims

by you or any third party relating to Luna or your possession and use of Luna, including but not limited to: (a) product liability claims; (b) any claim that Luna fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

  1. Intellectual property. In the event of any third-party claim that Luna

or your possession and use of Luna infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.

  1. Legal compliance. You represent and warrant that you are not located in

a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  1. Third-party terms. You must comply with any applicable third-party terms

of agreement when using Luna.

  1. Third-party beneficiary. Apple and Apple's subsidiaries are third-party

beneficiaries of these terms, and upon your acceptance of them, Apple will have the right — and will be deemed to have accepted the right — to enforce these terms against you as a third-party beneficiary.
